Before you sign up to use our platform, we kindly ask you to read the following terms and conditions carefully. By signing up on Nordsta, you agree to be bound by these terms and conditions, which govern your use of the platform.
Nordsta is a coaching marketplace that provides coachees with access to certified and experienced coaches. Nordsta does not provide coaching services directly but only acts as a platform to connect coachees with coaches. Coachees are responsible for selecting and engaging with coaches directly. Nordsta does not take responsibility for the quality or effectiveness of coaching services provided by coaches.
To use Nordsta, you must be at least 18 years old and capable of forming a legally binding agreement. By signing up, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.
To use Nordsta, you must create an account by providing your name, email address, and other required information. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify Nordsta immediately if you become aware of any unauthorized use of your account.
Nordsta charges a fee for its services, which may be paid by the coachee or the coach, depending on the arrangement between the parties. The fee is payable to Nordsta for each coaching session booked through the platform. Nordsta reserves the right to change its fee structure at any time and will provide notice of any changes.
Coachees are responsible for scheduling and attending coaching sessions with their selected coaches. Coachees must ensure that they have adequate internet connectivity and equipment to participate in coaching sessions via video conferencing or other means agreed upon with the coach. Coachees must also ensure that they are in a private and distraction-free environment during coaching sessions.
Coachees are responsible for making payments for coaching services directly to the coach through Nordsta's payment gateway. Nordsta does not store or handle any payment information provided by coachees or coaches.
Coachees may rate and review coaches based on their experience with coaching sessions. Nordsta reserves the right to moderate and remove reviews that violate its policies or are deemed inappropriate.
Nordsta may terminate or suspend your account and access to the platform at any time for any reason, including if you violate these terms and conditions. Upon termination, any outstanding fees or charges will become immediately due and payable.
Nordsta provides its services "as is" and without any warranty or guarantee of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Nordsta does not guarantee the accuracy, completeness, or reliability of any information provided on its platform, and disclaims any liability for any loss or damage arising from reliance on such information.
In no event shall Nordsta be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of its platform, including but not limited to loss of profits, revenue, data, or other intangible losses, even if Nordsta has been advised of the possibility of such damages.
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Nordsta is incorporated. Any dispute arising out of or in connection with these terms and conditions shall be resolved through arbitration in accordance with the rules of the arbitration association or court proceedings in the jurisdiction where Nordsta is incorporated.
You agree to indemnify and hold Nordsta and its affiliates, directors, officers, employees, and agents harmless from any and all claims, liabilities, damages, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the platform or your violation of these terms and conditions.
Nordsta reserves the right to modify or update these terms and conditions at any time by posting the revised terms on its platform. Your continued use of the platform after the revised terms are posted constitutes your acceptance of the changes.
These terms and conditions constitute the entire agreement between you and Nordsta regarding your use of the platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Nordsta.
You may not assign or transfer these terms and conditions or any of your rights or obligations hereunder, whether by operation of law or otherwise, without Nordsta's prior written consent. Nordsta may assign or transfer these terms and conditions without your consent
If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent possible.
Nordsta's failure to enforce any right or provision of these terms and conditions shall not be deemed a waiver of such right or provision.
Nordsta may use third-party services to provide certain features and functions of the platform, such as payment processing and video conferencing. Your use of these third-party services is subject to their respective terms and conditions, and Nordsta is not responsible for any issues or disputes arising from your use of these services.
The content and materials on the Nordsta platform, including but not limited to text, graphics, logos, images, and software, are the property of Nordsta or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on the content and materials without Nordsta's prior written consent.
Nordsta welcomes feedback and suggestions from coachees on how to improve its platform and services. By providing feedback or suggestions to Nordsta, you grant Nordsta a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, copy, modify, and distribute such feedback or suggestions in any form or medium.
Nordsta respects your privacy and is committed to protecting your personal information in accordance with its privacy policy. You acknowledge that coaching sessions may involve the exchange of sensitive and confidential information between coachees and coaches. Nordsta cannot guarantee the confidentiality or security of such information and is not responsible for any breach of confidentiality or privacy that may occur.
Nordsta shall not be liable for any failure or delay in the performance of its obligations under these terms and conditions due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, and natural disasters.
The provisions of these terms and conditions that by their nature should survive termination, including but not limited to indemnification, limitation of liability, and governing law and jurisdiction, shall survive any termination or expiration of these terms and conditions.
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction where Nordsta is incorporated, without giving effect to any principles of conflicts of law. You agree that any dispute arising out of or in connection with these terms and conditions or your use of the platform shall be resolved exclusively through arbitration in accordance with the rules of the jurisdiction where Nordsta is incorporated. The arbitration shall be conducted in English by a single arbitrator appointed by the arbitration service provider. The arbitrator's decision shall be final and binding on the parties, and judgment may be entered on the arbitrator's award in any court having jurisdiction thereof.
These terms and conditions are written in English. If these terms and conditions are translated into another language, the English language version shall prevail in the event of any conflict or discrepancy between the English language version and the translated version.
Any notice or communication required or permitted to be given under these terms and conditions shall be in writing and shall be deemed given when delivered personally, sent by email, or sent by registered or certified mail, return receipt requested, to the address specified in your account information or to Nordsta's registered address.
The headings used in these terms and conditions are for convenience only and shall not affect the interpretation of these terms and conditions.
Nothing in these terms and conditions shall be construed as creating a partnership, joint venture, agency, or employment relationship between you and Nordsta.
You agree to comply with all applicable laws, rules, and regulations in connection with your use of the platform.
Nordsta may terminate your access to the platform at any time, with or without cause, without prior notice, and without liability to you. Upon termination, all rights granted to you under these terms and conditions will immediately cease, and you must immediately cease all use of the platform.
